Welcome to Woof Spark. These Terms and Conditions (“Terms”) govern your use of our website www.woofspark.com.au, our online store, our grooming salon, and any related services we provide. By accessing our website or purchasing from us, you agree to be bound by these Terms.
We’ve written these Terms to be as clear and straightforward as possible. If anything is unclear, please contact us — we’re happy to explain.
1. Acceptance of Terms
By using our website, creating an account, placing an order, or booking a grooming appointment, you confirm that you:
- Have read and agree to these Terms and Conditions;
- Are at least 18 years of age or have the consent of a parent or guardian;
- Will use our website and services in accordance with these Terms and all applicable Australian laws.
If you do not agree with any part of these Terms, please do not use our website or services.
2. Use of the Website
You agree to use our website for lawful purposes only. When using our website, you must not:
- Use the site in any way that breaches any applicable local, state, or federal law or regulation;
- Attempt to gain unauthorised access to any part of the website, server, or database;
- Introduce viruses, trojans, worms, or other malicious software;
- Scrape, copy, or reproduce any content from the website without our written permission;
- Use automated tools (bots, crawlers, scrapers) to access the website beyond what is permitted by our robots.txt file;
- Impersonate any person or entity, or misrepresent your identity or affiliation.
We reserve the right to restrict or terminate your access to the website at any time if we reasonably believe you have breached these Terms.

Some features of our website, including placing orders through our online store, may require you to create an account.
When you create an account, you agree to:
- Provide accurate, current, and complete information;

- Notify us immediately if you become aware of any unauthorised use of your account;
- Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or close any account that we reasonably believe has been used in breach of these Terms.
4. Products and Services
Woof Spark offers the following products and services:
4.1 Dog Grooming Salon
In-person dog grooming appointments at our Cessnock salon. Specific terms for grooming services are set out in Section 11 below.
4.2 Physical Products
Dog grooming products and accessories available for purchase through our online store, with delivery across Australia.
4.3 Digital Products
Downloadable PDF guides related to dog grooming and care. Digital products are delivered electronically and are non-refundable once downloaded, subject to your rights under Australian Consumer Law.
4.4 Custom Digital Pet Portraits
Custom digital artwork of your pet, created from photos you provide. By submitting photos for a portrait order, you confirm that you own or have permission to use those photos and grant us a licence to use them for the purpose of creating your portrait. Portrait orders are custom-made to your specifications.
4.5 Blog Content
Our website features informational blog content about dog grooming, care, and related topics. This content is provided for general information only and does not constitute professional veterinary advice. Always consult a qualified veterinarian for health concerns about your pet.
We make every effort to display product colours, images, and descriptions accurately on our website. However, we cannot guarantee that your device’s display will accurately reflect the actual appearance of products.
5. Pricing and Payment
All prices on our website are displayed in Australian Dollars (AUD) and include GST where applicable.
We accept the following payment methods:
- Credit and debit cards (Visa, Mastercard, American Express) processed securely via Square;
- Afterpay (buy now, pay later — subject to Afterpay’s own terms and conditions);
- Any other payment methods displayed at checkout.
Payment is required in full at the time of purchase unless you are using Afterpay, in which case Afterpay’s instalment terms apply.
While we make every effort to ensure pricing accuracy, errors may occasionally occur. If we discover a pricing error on an order you have placed, we will contact you before processing the order to confirm whether you wish to proceed at the correct price.
6. Shipping and Delivery
We ship physical products Australia-wide. Shipping costs vary depending on the product, size, weight, and destination, and are calculated and displayed at checkout before you complete your purchase.
Estimated delivery timeframes are provided at checkout and in your order confirmation email. These are estimates only and are not guaranteed delivery dates.
Important:
- If you provide an incorrect or incomplete delivery address, we are not responsible for non-delivery. Re-shipping costs may apply.
- If a parcel is returned to us as undeliverable, we will contact you to arrange re-delivery at your cost.
- For items that appear lost in transit, please contact us. We will work with the carrier to locate your order or arrange a resolution.
Digital products (PDF guides and digital portraits) are delivered electronically to the email address associated with your order.
7. Returns and Refunds
Our returns and refund practices are detailed in our separate Refund & Returns Policy, which forms part of these Terms.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
8. Intellectual Property
All content on the Woof Spark website — including text, blog articles, photographs, illustrations, product images, digital portrait artwork, graphics, logos, and videos — is the property of Woof Spark Pty Limited or its licensors and is protected by Australian and international copyright and intellectual property laws.
8.1 Digital Pet Portraits
When you purchase a custom digital pet portrait, you receive a personal, non-exclusive, non-transferable licence to use the portrait for personal, non-commercial purposes. Woof Spark retains copyright ownership of all portrait artwork. We may use completed portraits in our portfolio and marketing materials unless you request otherwise in writing.
8.2 Blog Content
You may share links to our content but may not copy, reproduce, or republish full articles without written permission. Brief excerpts with proper attribution and a link back to the original article are permitted.
9. User-Generated Content
By submitting reviews, comments, photos, or other content (“User Content”), you:
- Grant Woof Spark a non-exclusive, royalty-free, worldwide, perpetual licence to use, display, reproduce, and distribute your User Content in connection with our business;
- Confirm that you own or have the necessary rights to the content you submit;
- Agree that your content is not false, misleading, defamatory, or otherwise unlawful.
We reserve the right to remove any User Content at our sole discretion. You retain ownership of your User Content, subject to the licence granted above.
10. Limitation of Liability
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.
Subject to the above, and to the maximum extent permitted by law:
- Woof Spark’s total liability to you for any claim is limited to the amount you paid for the specific product or service giving rise to the claim;
- We are not liable for any indirect, incidental, special, consequential, or punitive damages;
- We are not liable for any loss or damage arising from circumstances beyond our reasonable control.
11. Grooming Services
11.1 Bookings
Grooming appointments can be booked through our website, by phone, or in person. A booking is confirmed once you receive a confirmation from us.
11.2 Cancellation Policy
We ask that you give us at least 24 hours’ notice if you need to cancel or reschedule your appointment. Late cancellations may incur a cancellation fee.
11.3 No-Show Policy
If you do not arrive for your scheduled appointment without prior notice, a no-show fee may apply. Repeated no-shows may result in a requirement to pay a deposit for future bookings.
11.4 Pet Health and Safety
By booking a grooming appointment, you confirm that:
- Your dog is up to date on vaccinations;
- You have disclosed any known health conditions, allergies, injuries, or behavioural concerns;
- Your dog is free from contagious diseases or parasites to the best of your knowledge.
11.5 Owner Consent
By dropping off your dog for grooming, you consent to the services requested and acknowledge that while we take every precaution, there is an inherent minor risk of nicks, scratches, or stress during grooming, particularly for dogs that are nervous, matted, elderly, or have pre-existing skin conditions. Our groomers will always prioritise your dog’s safety and wellbeing.
11.6 Matting and Coat Condition
Severely matted coats may require a shorter clip than originally requested. De-matting can be painful and stressful for dogs, and our groomers will always prioritise comfort and welfare. Additional charges may apply for severely matted coats.
12. Privacy
Our collection, use, storage, and disclosure of your personal information is governed by our separate Privacy Policy, which forms part of these Terms and complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
13. Changes to These Terms
We may update these Terms from time to time. The updated Terms will be posted on this page with a revised “Last updated” date. Your continued use of our website or services after any changes constitutes your acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth courts of Australia.
Nothing in this clause limits your right to lodge a complaint with NSW Fair Trading or the Australian Competition and Consumer Commission (ACCC).
15. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy and Refund & Returns Policy, constitute the entire agreement between you and Woof Spark.
- Severability: If any provision is found to be invalid, the remaining provisions continue in full force.
- Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
